Terms of Service

1. Acceptance of Terms

By using the Psycademy Society website (the “Site”) or purchasing any courses through our Site, you agree to these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use our Site or services. These Terms form a binding agreement between you (the user) and Psycademy Society (“we”, “us”, or “our”), a non-profit organization based in Canada. We reserve the right to update or modify these Terms at any time. We will notify users by updating the “Last Updated” date above. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

2. Our Services and Third-Party Course Providers

Psycademy Society operates a platform where users can purchase access to online courses. Important: We license these courses from third-party providers. This means that while you purchase the course through our Site, the course content and delivery are provided by independent third-party organizations or instructors (“Course Provider”). We do not create, run, or control the course content, and we are not responsible for its quality, accuracy, or legality. Our role is limited to facilitating your enrollment and payment for the course. Upon purchase, you will be registered into the course with the Course Provider, who will then manage all aspects of course delivery (such as access to materials, lessons, evaluations, etc.).

Because the courses are provided by third parties, you may be required to agree to the Course Provider’s own terms of service, user agreement, or privacy policy when you access their course platform. Those agreements are between you and the Course Provider. We are not responsible for the content, availability, or your experience on any third-party course platform, nor for the privacy practices of the Course Provider. We do not endorse or assume liability for any statements, opinions, or information provided in the courses by the third-party providers. If you have any issues or disputes regarding the course content or delivery, you should contact the Course Provider, though you can also inform us and we will do our best to facilitate a resolution.

3. User Accounts and Registration

In order to purchase a course, you may need to provide certain personal information (e.g. your name, email address, billing information) at the point of sale. You agree that any information you provide is accurate, complete, and yours to provide. You must be of legal age of majority in your province/state or country of residence (usually 18 years or older) to purchase courses on our Site. If you are under the age of majority, you may only use our services with the involvement and consent of a parent or legal guardian. By registering for a course or providing your information, you represent that you meet these eligibility requirements.

You are responsible for maintaining the confidentiality of any account credentials or purchase information (for example, if the Site provides you with an order or registration number). You agree to notify us immediately of any unauthorized use of your account or purchase information. We are not liable for any loss or damage arising from your failure to protect your information.

4. Payments and Orders

All prices for courses are listed in the currency specified on the Site (e.g., Canadian dollars or Australian dollars) and are subject to applicable taxes if any. When you purchase a course, you agree to pay the listed price and any applicable taxes or fees. Payment processing is handled through third-party payment processors, specifically PayPal. We do not directly collect or store your credit card or banking details on our servers – your payment information is securely handled by PayPal. All transactions are encrypted through PayPal’s system, and your purchase is subject to PayPal’s terms and privacy policy. Once your payment is successfully completed, we will send you an order confirmation (typically via email) and arrange for your enrollment in the course.

Order Fulfillment: After payment, we will provide the necessary information to the Course Provider to enroll you (such as your name and email for course access). The Course Provider will then grant you access to the course materials. Please ensure the email you provide is correct and that you monitor it for course access instructions. If you encounter any issues accessing the course, contact us for assistance.

Refunds and Cancellations: Due to the digital nature of online courses and the involvement of third-party providers, all sales are generally final. Once you have been enrolled in a third-party course, we cannot usually cancel your enrollment or issue a refund, except as required under applicable law or under exceptional circumstances. However, we want you to be satisfied – if you believe you have a valid reason for a refund (such as not receiving access to the course you purchased), please contact us. We will review requests on a case-by-case basis in coordination with the Course Provider. Nothing in these Terms is intended to limit any rights you may have under consumer protection laws (for example, statutory rights to refunds) that apply to your purchase.

5. User Conduct and Prohibited Uses

You agree to use our Site and services only for lawful purposes and in accordance with these Terms. You must not engage in any of the following activities:

  • Illegal Activities: Do not use the Site to conduct or facilitate any unlawful act, or to violate any laws or regulations.
  • Interference: Do not attempt to interfere with the functioning of our Site or anyone’s transactions. This includes not introducing viruses, malware, or any code harmful to the Site, and not attempting to gain unauthorized access to our systems.
  • False Information or Impersonation: Do not provide false or misleading information in any purchase or communication with us. Do not impersonate any other person or entity, or misrepresent your affiliation with any person or entity.
  • Abusive Behavior: Do not engage in harassing, threatening, abusive, or defamatory behavior toward us or other users of the Site. Any communication you have with our staff or through our Site must be respectful and lawful.
  • Intellectual Property Misuse: Do not attempt to copy, reproduce, redistribute, or resell any portion of the course content or our Site content, except as allowed by the respective owner. (See Intellectual Property section below.)
  • Other: You must not use the Site in any manner that could damage, disable, overburden, or impair the Site, or interfere with any other party’s use and enjoyment of the Site.

Violating any of the above rules may result in termination of your access to the Site or courses without notice, and may also result in legal consequences.

6. Intellectual Property Rights

All content and materials on the Psycademy Society website (including text, graphics, logos, and site design) are owned by or licensed to Psycademy Society and are protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to access and use the Site for the purpose of browsing and purchasing courses. You may not reproduce, distribute, modify, or create derivative works from our website content unless you have our explicit written permission.

Course Content: The courses available through our Site are created by third-party Course Providers and are licensed to Psycademy Society for distribution. All intellectual property rights in the course materials (videos, documents, quizzes, etc.) remain with the Course Provider or the original content creators. When you purchase a course, you are granted a personal, non-transferable, limited license by the Course Provider to access and use the course materials for your own educational purposes. You must not share, copy, redistribute, or publish any course materials to anyone who has not legitimately purchased the course. Any unauthorized use of the course content may violate the Course Provider’s intellectual property rights and could result in termination of your access to the course and legal action.

If you believe that any content on our Site or in a course infringes your copyright or other intellectual property rights, please notify us with detailed information so that we can investigate and address the issue in accordance with applicable law.

7. Disclaimers of Warranties

“As-Is” Service: Psycademy Society provides the Site and our services (including facilitating access to third-party courses) on an “as is” and “as available” basis. We make no warranties or representations, express or implied, about the reliability, suitability, or availability of the Site or the courses we offer, to the fullest extent permitted by law. Use of our Site and the purchased courses is at your own risk.

Course Content: Since course content is produced and maintained by independent third-party providers, we do not warrant or guarantee that the content is up-to-date, accurate, or will meet your expectations or learning needs. We also cannot guarantee that the course will lead to any particular outcome or skill advancement for you. The Course Provider is solely responsible for the content and quality of the course. We expressly disclaim any liability for any errors or omissions in the course content and for any outcomes or results you may experience by using that content. Any advice, information, or opinions presented in a course belong to the Course Provider and not to Psycademy Society. You should exercise your own judgment and, if needed, seek professional advice before relying on course information for any important decisions.

No Professional Advice: Unless explicitly stated, the courses are for general educational purposes and are not provided as professional advice (for example, medical, legal, financial, or psychological advice). Psycademy Society is not a professional advisory organization, and purchasing or completing a course does not establish any professional-client relationship between you and us. Always consult a qualified professional if you need specific advice related to the course subject matter.

Site Availability: We strive to keep our Site operational and accessible, but we do not guarantee that the Site will be uninterrupted, error-free, or secure at all times. Technical issues or maintenance may occasionally make the Site unavailable. We will attempt to provide advance notice of scheduled downtime, but we are not liable for any inconvenience or loss caused by unavailability of the Site.

Third-Party Websites: Our Site may contain links to other websites or services (for example, the website of a Course Provider or PayPal’s site for payment). These links are provided for your convenience. However, we do not control third-party websites. Accessing third-party sites is at your own risk, and those sites are subject to their own terms and policies. We make no warranties and bear no responsibility for any third-party websites or content they provide.

Some jurisdictions do not allow certain warranty disclaimers. If such laws apply to you, some of the above disclaimers may not apply to the extent disallowed by law. However, in any case, our disclaimers apply to the maximum extent permitted by applicable law.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Psycademy Society and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from: (a) your use of or inability to use the Site; (b) your purchase or use of any course (including any damage or loss arising from content errors or omissions, or any dispute with a Course Provider); or (c) unauthorized access to or use of our servers or any personal information stored therein.

Our total liability for any claim arising out of or relating to these Terms or the use of our services, regardless of the form of the action, is limited to the amount you paid us for the course in question. If no purchase is involved, our liability is limited to $100 CAD. This limitation applies even if we have been advised of the possibility of such damages, and regardless of any failure of essential purpose of any limited remedy.

Third-Party Course Liability: Since the actual course is delivered by a third party, any issues that occur within the course platform or content (such as technical problems, content inaccuracies, or personal injury claims arising from course material) are fundamentally between you and the Course Provider. Psycademy Society is not liable for damages arising from the actions or omissions of third-party Course Providers. We do not assume responsibility for any loss or harm incurred as a result of taking the course or reliance on the course materials.

Nothing in these Terms is intended to exclude or limit any condition, warranty, right or liability which may not be lawfully excluded or limited under applicable law (for example, certain consumer rights under Canadian or Australian law). To the extent that an implied warranty or statutory protection cannot be excluded, we limit our liability to the minimum amount permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Psycademy Society and its affiliates, and each of their respective officers, directors, volunteers, employees, and agents (“Indemnified Parties”), from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable legal fees) that arise out of or relate to: (a) your use or misuse of the Site or any course; (b) your violation of these Terms or any applicable law or regulation; or (c) your infringement of any intellectual property or other rights of any third party. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (at your expense), and you agree to cooperate with our defense of such claims. This indemnity obligation will survive termination of your use of our services.

10. Governing Law and Jurisdiction

These Terms of Service and any disputes arising under them will be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict of law principles. By using our services, you agree that any legal action or proceeding concerning these Terms shall be brought in the courts of the Province of Ontario, Canada, and you hereby consent to the personal jurisdiction of such courts.

If you are using our services in Australia, you may have additional rights under Australian consumer protection laws. Nothing in these Terms is intended to override or diminish any rights or remedies you have under the Australian Consumer Law or other local laws that cannot be lawfully limited or excluded. For Australian users, to the extent permitted, the laws of Ontario, Canada will still apply to the interpretation of these Terms and any disputes (except where local mandatory laws require otherwise).

11. Termination

We reserve the right to terminate or suspend your access to the Site or any course, without prior notice, if you violate these Terms or if we otherwise reasonably suspect fraudulent or unlawful activity associated with your account or purchase. In the event of termination due to your breach of Terms, you will not be entitled to any refund. We also reserve the right to discontinue offering any course or to cease our website operations at any time, in which case our liability to you will be limited to refunding any prepaid fees for undelivered courses.

12. General Provisions

  • Entire Agreement: These Terms (along with any additional policies like our Privacy Policy) represent the entire agreement between you and Psycademy Society regarding your use of our Site and services, and supersede any prior agreements or understandings.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be deemed severable from the Terms and will not affect the validity and enforceability of the remaining provisions.
  • No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Psycademy Society.
  • Assignment: You may not assign or transfer your rights or obligations under these Terms to anyone else without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, or sale of assets.
  • Headings: Section headings in these Terms are for convenience only and have no legal or contractual effect.

1. Introduction

Psycademy Society is committed to protecting your privacy. This Privacy Policy explains what personal information we collect from users of our Site and purchasers of our courses, how we use and share that information, and your rights regarding your information. This Policy applies to all services offered through our Site to users in Canada, Australia, and any other country. We do not collect or store your credit card or bank account numbers on our servers – payments are handled by PayPal, and we only receive confirmation of payment and basic details required to fulfill your order. (For example, PayPal may provide us with your name, email, and confirmation that payment was made, but we do not have access to your full payment account details.)
  • Payment Information: All payments are processed via PayPal. When you pay for a course, you are using PayPal’s secure payment system. We do not see your credit card number or bank information; PayPal just notifies us that the payment was completed. PayPal may also share your billing address or other payment-related details with us if needed for record-keeping, but again, we do not handle your sensitive financial data directly. Communication is largely transactional or service-related (e.g., sending your login details for the course, responding to customer support inquiries, or notifying you of any important changes in our services).
  • For Customer Support: If you contact us for help or with questions, we will use your information to assist you. 4. How We Share or Disclose Information

Psycademy Society respects your privacy – we do not sell or rent your personal data to third parties for their marketing or any other purposes. We only share your information in a few specific circumstances, outlined below, and always with appropriate safeguards:

  • With Third-Party Course Providers: Since a third-party Course Provider will be delivering the course you purchase, we must share certain information with them to enroll you. Typically, this includes your name and email address (so they can create an account for you on their learning platform or add you to the class roster). In some cases, the Course Provider might also require additional details such as your city/country (for localization) or any specific enrollment info. We only share the data that is necessary for the Course Provider to provide you access to the course and administer your participation. The Course Provider is contractually obligated to use that information solely for providing the course and not for other purposes. However, please note that the Course Provider will process your data under their own privacy policy as well, which we don’t control. We advise you to review the Course Provider’s privacy policy when you begin the course to understand how they handle your data.
  • With Payment Processors (PayPal): As mentioned, we use PayPal to handle payments. When you make a purchase, you are interacting directly with PayPal. We provide PayPal with the amount to charge and perhaps an order identifier, and PayPal provides us confirmation of payment. PayPal may receive personal information directly from you (such as your credit card number, billing address, etc.) in order to process the payment; that information is governed by PayPal’s own privacy policy and not by Psycademy Society. We may receive some information back from PayPal (like your name, email, and a transaction ID) to confirm the transaction. All PayPal transactions are encrypted and processed securely, and are subject to PayPal’s Privacy Policy. We recommend you review PayPal’s Privacy Policy to see how they handle your payment data. In summary, we share the necessary information with PayPal to complete the transaction, and PayPal shares back confirmation and details that we need for record-keeping.
  • With Service Providers: We may use trusted third-party service providers to help us operate our organization and the Site. For example, we might use a web hosting provider for our website, an email service (like MailChimp or similar) to send out our newsletters (if you opted in), or cloud storage/IT providers to store data securely. These service providers may have access to personal information only to perform specific tasks on our behalf. For instance, if we use an email marketing service to send out newsletters, they would handle your email address for that purpose. We ensure that all such providers are bound by confidentiality and privacy obligations (through contracts or terms of service) and that they are not permitted to use your data for anything other than the agreed-upon service.
  • With Legal or Safety Authorities: We may disclose personal information when required to do so by law or if we have a good-faith belief that such action is necessary to (a) comply with a legal obligation (such as a subpoena, court order, or government demand); (b) protect and defend the rights or property of Psycademy Society; (c) prevent or investigate possible wrongdoing, fraud, or security issues; or (d) protect the personal safety of our users or the public. If we receive a lawful request for user data from law enforcement or regulators, we will attempt to ensure such requests are legally valid and only provide the minimum necessary information.
  • Business Transfers: This is unlikely for a non-profit like us, but we mention it for completeness. If Psycademy Society undergoes a significant change (such as a merger with another organization, acquisition, or transfer of our operations and assets), user information may be one of the assets transferred to the successor organization. Should such a transfer occur, we will ensure that your personal information remains protected and that the new entity continues to honor the commitments we have made in this Privacy Policy (or provides notice and obtains consent for any significant changes). We would notify users of any ownership change or transfer of personal data.

In all cases of sharing, we adhere to the principle of data minimization: we only share the least amount of information necessary for the task. We also strive to anonymize or aggregate data when disclosing information that does not need to be personally identifiable.

5. International Data Transfers

Psycademy Society is based in Canada, but our services are available to users in multiple countries (notably Canada and Australia, as well as others). When you provide information to us, it may be processed and stored in Canada or in other countries where our service providers or Course Providers are located.

  • Canada & Australia: If you are in Australia, understand that your personal data will be transferred to us in Canada so we can process your order. Canada is generally considered to have strong privacy protections (it is recognized by the EU as providing an adequate level of data protection), and we handle your data in line with our laws and this Policy. If you are in Canada, but the Course Provider is in Australia, then some of your data will be transferred to Australia so that the Course Provider can enroll you. Australia also has its own robust privacy laws. We will ensure that any transfer of personal information between Canada and Australia (or any other country) complies with applicable legal requirements. By using our Site and providing information, you consent to this transfer of your data.
  • Other Countries: The third-party services we use (like PayPal or possibly our website host, email service, etc.) may store or process data in the United States or other jurisdictions. PayPal, for example, is a global company based in the U.S., so your payment data will likely travel through and be stored in the U.S. Similarly, if our website is hosted on servers in another country (e.g., the U.S.), or if we use a cloud service with servers in other regions, your data could be stored or processed there. We take steps to ensure any international transfers are done securely. Many of our service providers are large companies that participate in cross-border data protection frameworks or have standard contractual clauses in place to safeguard data transfers.

We want to highlight that when your data is handled by third parties in other jurisdictions, it may become subject to the laws of those jurisdictions (for instance, foreign governments could potentially access it under their laws). However, we choose reputable providers and wherever feasible, we include contractual commitments that they will protect your information to the same standards we uphold.

7. Data Retention

Typically, we might retain order information for a number of years to comply with tax and financial regulations. For instance, organizations often need to keep financial transaction records for at least 6-7 years for auditing purposes.
  • If you have opted into marketing emails, we will keep your contact information on our mailing list until you unsubscribe or ask us to remove it. Upon unsubscribing, we may keep a record that you unsubscribed (to ensure we respect that going forward).
